  1. นโยบายความเป็นส่วนตัวของเรา

บริษัท นิโปร เซลส์ (ประเทศไทย) จำกัด (“บริษัทฯ” หรือ “เรา”) ได้จัดตั้ง สถาบันเพื่อการประกอบวิชาชีพทางการแพทย์ (“iMEP”) เพื่อให้บริการโปรแกรมเกี่ยวกับการศึกษาและการพัฒนาวิชาชีพ ที่ออกแบบมาเพื่อส่งเสริมความรู้ ทักษะ และความเชี่ยวชาญของพยาบาล วิศวกรคลินิก แพทย์ และบุคลากรทางการแพทย์อื่น ๆ รวมถึงบุคคลดังกล่าวที่ประกอบวิชาชีพอยู่ในประเทศไทย

ในการดำเนินงานและจัดการการสัมมนาหรือโปรแกรมการฝึกอบรมของ iMEP บริษัทฯ จะเก็บรวบรวมและประมวลผลข้อมูลส่วนบุคคลของบุคคลที่เข้าร่วม หรือแสดงความสนใจที่จะเข้าร่วมการสัมมนาหรือโปรแกรมการฝึกอบรมของบริษัทฯ ทั้งนี้ ข้อมูลส่วนบุคคลดังกล่าวอาจถูกเก็บรวบรวมผ่าน LINE Official Account (“LINE OA”) หรือเว็บไซต์ของบริษัทฯ และช่องทางการสื่อสารอื่น ๆ ที่บริษัทฯ จัดให้มีขึ้น

เนื่องจากการคุ้มครองข้อมูลส่วนบุคคลของท่านมีความสำคัญอย่างยิ่งต่อบริษัทฯ บริษัทฯ จึงได้จัดทำและเผยแพร่นโยบายความเป็นส่วนตัวฉบับนี้เพื่ออธิบายถึงวิธีการที่บริษัทฯ เก็บรวบรวม ใช้ เปิดเผย จัดเก็บ และประมวลผลข้อมูลส่วนบุคคลของท่าน

บริษัทฯ จะประมวลผลข้อมูลส่วนบุคคลของท่านตามกฎหมายและระเบียบที่เกี่ยวข้องกับการคุ้มครองข้อมูลส่วนบุคคลที่ใช้บังคับ ซึ่งรวมถึงพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 (ค.ศ. 2019) และกฎหมายลำดับรองของพระราชบัญญัติดังกล่าว (ซึ่งต่อไปนี้เรียกรวมกันว่า “PDPA”) ทั้งนี้ เพื่อให้เป็นไปตามวัตถุประสงค์ของ PDPA บริษัทฯ ทำหน้าที่เป็นผู้ควบคุมข้อมูลในส่วนที่เกี่ยวกับข้อมูลส่วนบุคคลที่อธิบายไว้ในนโยบายความเป็นส่วนตัวฉบับนี้

นโยบายความเป็นส่วนตัวฉบับนี้อธิบายถึงประเภทของข้อมูลส่วนบุคคลที่บริษัทฯ เก็บรวบรวม วัตถุประสงค์ในการประมวลผลข้อมูลดังกล่าว ฐานทางกฎหมายสำหรับการประมวลผล บุคคลหรือนิติบุคคลที่บริษัทฯ อาจเปิดเผยข้อมูลส่วนบุคคลของท่าน ระยะเวลาที่บริษัทฯ จะเก็บรักษาข้อมูลส่วนบุคคลของท่าน สิทธิของท่านในฐานะเจ้าของข้อมูล และมาตรการที่บริษัทฯ ใช้เพื่อคุ้มครองข้อมูลส่วนบุคคลของท่าน

บริษัทฯ อาจทบทวนและปรับปรุงนโยบายความเป็นส่วนตัวฉบับนี้เป็นครั้งคราว เพื่อให้สอดคล้องกับการเปลี่ยนแปลงในการดำเนินธุรกิจ กฎหมายที่ใช้บังคับ หรือข้อกำหนดด้านกฎระเบียบที่เกี่ยวข้อง ทั้งนี้ หากมีการเปลี่ยนแปลงในสาระสำคัญ บริษัทฯ จะแจ้งให้ท่านทราบผ่านช่องทางที่เหมาะสมตามข้อกำหนดทางกฎหมายที่ใช้บังคับ

  1. ข้อมูลส่วนบุคคลที่เก็บรวบรวม

เพื่อวัตถุประสงค์ของนโยบายความเป็นส่วนตัวฉบับนี้ “ข้อมูลส่วนบุคคล” หมายถึง ข้อมูลเกี่ยวกับบุคคลซึ่งทำให้สามารถระบุตัวตนบุคคลนั้นได้ไม่ว่าทางตรงหรือทางอ้อม แต่ไม่รวมถึงข้อมูลของผู้ถึงแก่กรรม ตามที่กำหนดไว้ใน PDPA

บริษัทฯ จะเก็บรวบรวมข้อมูลส่วนบุคคลของท่านโดยตรงจากท่าน เมื่อท่านลงทะเบียน สอบถามเกี่ยวกับ หรือเข้าร่วมการสัมมนาหรือโปรแกรมการฝึกอบรม ผ่านทาง LINE OA หรือเว็บไซต์ของบริษัทฯ หรือช่องทางการสื่อสารอื่น ๆ ทั้งนี้ บริษัทฯ จะประมวลผลข้อมูลส่วนบุคคลของท่านเฉพาะเท่าที่จำเป็นเพื่อให้บรรลุวัตถุประสงค์ที่กำหนดไว้ในนโยบายความเป็นส่วนตัวฉบับนี้ และตามฐานทางกฎหมายที่กำหนดไว้ภายใต้ PDPA

ข้อมูลส่วนบุคคลที่บริษัทฯ เก็บรวบรวมอาจแตกต่างกันตามลักษณะการติดต่อระหว่างท่านกับบริษัทฯ โดยบริษัทฯ อาจเก็บรวบรวมข้อมูลส่วนบุคคลของท่าน ดังต่อไปนี้

  • ข้อมูลระบุตัวตน เช่น ชื่อ นามสกุล ชื่อ LINE และบัญชี LINE ของท่าน
  • ข้อมูลการติดต่อ เช่น ที่อยู่อีเมล หมายเลขโทรศัพท์ และรายละเอียดการติดต่ออื่น ๆ ที่ท่านให้ไว้
  • ข้อมูลด้านวิชาชีพ เช่น วิชาชีพหรือตำแหน่งงานของท่าน (เช่น แพทย์ พยาบาล เภสัชกร วิศวกรคลินิก หรือบุคลากรทางการแพทย์อื่น ๆ) และสาขาความเชี่ยวชาญของท่าน
  • ข้อมูลเกี่ยวกับหน่วยงานต้นสังกัด เช่น ชื่อโรงพยาบาล คลินิก สถานพยาบาล นายจ้าง หรือองค์กรอื่น ๆ ที่ท่านสังกัด

บริษัทฯ ไม่มีความประสงค์ที่จะเก็บรวบรวมหรือประมวลผลข้อมูลส่วนบุคคลของท่านที่มีลักษณะเป็นข้อมูลส่วนบุคคลที่มีความอ่อนไหว อย่างไรก็ตาม หากมีความจำเป็นต้องเก็บรวบรวมหรือประมวลผลข้อมูลส่วนบุคคลที่มีความอ่อนไหวเพื่อวัตถุประสงค์ที่ชอบด้วยกฎหมาย บริษัทฯ จะดำเนินการตามที่ PDPA กำหนดเท่านั้น ซึ่งรวมถึงการขอความยินยอมโดยชัดแจ้งจากท่านในกรณีที่กฎหมายกำหนด หรืออาศัยฐานทางกฎหมายอื่นที่ได้รับอนุญาตภายใต้ PDPA

  1. วัตถุประสงค์ในการประมวลผลข้อมูลส่วนบุคคล

บริษัทฯ จะเก็บรวบรวม ใช้ และเปิดเผยข้อมูลส่วนบุคคลของท่านเฉพาะเท่าที่จำเป็นสำหรับวัตถุประสงค์ ดังต่อไปนี้:

  • เพื่อดำเนินการและจัดการการลงทะเบียนเข้าร่วมการสัมมนาหรือโปรแกรมการฝึกอบรมของบริษัทฯ รวมถึงการลงทะเบียนออนไลน์ผ่านเว็บไซต์ของบริษัทฯ
  • เพื่อบริหารจัดการและอำนวยความสะดวกในการดำเนินการสัมมนาหรือโปรแกรมการฝึกอบรมของบริษัทฯ รวมถึงการตรวจสอบคุณสมบัติของท่าน การจัดการการเข้าร่วม การจัดทำบันทึกข้อมูลผู้เข้าร่วม การออกใบรับรอง (หากมี) และการสนับสนุนด้านการบริหารจัดการที่เกี่ยวข้อง
  • เพื่อสื่อสารกับท่านเกี่ยวกับการลงทะเบียน การเข้าร่วม และเรื่องอื่น ๆ ที่เกี่ยวข้องกับการสัมมนาหรือโปรแกรมการฝึกอบรม รวมถึงการส่งข้อมูลยืนยัน การแจ้งเตือน การแจ้งกำหนดการ การอัปเดตข้อมูล การแจ้งเอกสารประกอบการสัมมนาหรือโปรแกรมการฝึกอบรม และข้อมูลอื่น ๆ ที่เกี่ยวข้องให้แก่ท่าน
  • เพื่อเชิญท่านเข้าร่วมการสัมมนาหรือโปรแกรมการฝึกอบรม การประชุมเชิงปฏิบัติการ กิจกรรมด้านการศึกษา หรือกิจกรรมอื่น ๆ เพื่อพัฒนาความรู้และทักษะทางวิชาชีพในอนาคต ซึ่งจะจัดขึ้นหรือได้รับการสนับสนุนโดยบริษัทฯ ทั้งนี้ เท่าที่กฎหมายที่ใช้บังคับอนุญาต
  • เพื่อแจ้งข้อมูลข่าวสารและข้อมูลสำคัญเกี่ยวกับการสัมมนาหรือโปรแกรมการฝึกอบรม กิจกรรมด้านการศึกษา หรือกิจกรรมอื่น ๆ ที่บริษัทฯ จัดขึ้น
  • เพื่อดำเนินการตอบข้อสอบถาม ความคิดเห็น ข้อเสนอแนะ หรือคำขอของท่านที่ส่งผ่านทางเว็บไซต์ของบริษัทฯ LINE OA หรือแพลตฟอร์มอิเล็กทรอนิกส์อื่น ๆ
  • เพื่อดำเนินการ บริหารจัดการ ดูแลรักษา ประเมิน และปรับปรุง การสัมมนาหรือโปรแกรมการฝึกอบรม เว็บไซต์ แพลตฟอร์มดิจิทัล และบริการที่เกี่ยวข้องของบริษัทฯ รวมถึงการวิเคราะห์ภายในและการประเมินการมีส่วนร่วมของผู้เข้าร่วม เพื่อยกระดับคุณภาพและประสิทธิภาพของกิจกรรมด้านการศึกษาของบริษัทฯ
  • เพื่อปฏิบัติตามกฎหมาย ข้อบังคับ และข้อกำหนดด้านกฎระเบียบที่ใช้บังคับ รวมถึงคำขอที่ชอบด้วยกฎหมายจากหน่วยงานของรัฐหรือหน่วยงานกำกับดูแลที่มีอำนาจ และเพื่อก่อตั้ง ใช้สิทธิ หรือปกป้องสิทธิทางกฎหมายของบริษัทฯ เมื่อมีความจำเป็น
  1. ฐานทางกฎหมายสำหรับการประมวลผลข้อมูลส่วนบุคคล

บริษัทฯ จะประมวลผลข้อมูลส่วนบุคคลของท่านต่อเมื่อมีฐานทางกฎหมายที่รองรับการประมวลผลดังกล่าวภายใต้ PDPA โดยบริษัทฯ อาจอาศัยฐานทางกฎหมายหนึ่งฐานหรือหลายฐานดังต่อไปนี้ ขึ้นอยู่กับวัตถุประสงค์ของการประมวลผลข้อมูลส่วนบุคคล:

  • ความยินยอม: ในกรณีที่ PDPA กำหนดให้ต้องได้รับความยินยอมจากท่าน บริษัทฯ จะขอความยินยอมจากท่านก่อนเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของท่าน
  • ความจำเป็นในการปฏิบัติตามสัญญา: ในกรณีที่การประมวลผลมีความจำเป็นต่อการปฏิบัติตามสัญญาที่ท่านเป็นคู่สัญญา หรือเพื่อดำเนินการตามคำขอของท่านก่อนเข้าทำสัญญาดังกล่าว รวมถึงการดำเนินการเกี่ยวกับการลงทะเบียนและการเข้าร่วมการสัมมนาหรือโปรแกรมการฝึกอบรมของบริษัทฯ
  • ความจำเป็นเพื่อประโยชน์โดยชอบด้วยกฎหมาย: ในกรณีที่การประมวลผลมีความจำเป็นเพื่อประโยชน์โดยชอบด้วยกฎหมายของบริษัทฯ หรือบุคคลภายนอก โดยประโยชน์ดังกล่าวจะต้องไม่เหนือกว่าสิทธิและเสรีภาพขั้นพื้นฐานของท่านที่เกี่ยวข้องกับการคุ้มครองข้อมูลส่วนบุคคลของท่าน ตัวอย่างการประมวลผลดังกล่าว ได้แก่ การบริหารจัดการและปรับปรุงการสัมมนาหรือโปรแกรมการฝึกอบรมของบริษัทฯ การติดต่อสื่อสารกับผู้เข้าร่วม การรักษาความปลอดภัยของระบบของบริษัทฯ และการบริหารจัดการการดำเนินธุรกิจของบริษัทฯ
  • ความจำเป็นเพื่อปฏิบัติตามหน้าที่ตามกฎหมาย: ในกรณีที่การประมวลผลมีความจำเป็นเพื่อให้บริษัทฯ ปฏิบัติตามหน้าที่ตามกฎหมายหรือข้อกำหนด กฎ หรือระเบียบภายใต้กฎหมายที่ใช้บังคับ

ในกรณีที่กฎหมายกำหนดให้ท่านต้องให้ข้อมูลส่วนบุคคล หรือการให้ข้อมูลส่วนบุคคลดังกล่าวมีความจำเป็นต่อการปฏิบัติตามสัญญาหรือการเข้าทำสัญญา บริษัทฯ จะแจ้งให้ท่านทราบตามความเหมาะสม หากท่านไม่ให้ข้อมูลส่วนบุคคลที่จำเป็นดังกล่าว บริษัทฯ อาจไม่สามารถดำเนินการลงทะเบียนของท่าน ให้บริการตามที่ท่านร้องขอ หรือปฏิบัติตามหน้าที่ตามกฎหมายหรือสัญญาของบริษัทฯ ได้

  1. การเก็บรักษาข้อมูลส่วนบุคคล

บริษัทฯ จะเก็บรักษาข้อมูลส่วนบุคคลของท่านไว้เพียงระยะเวลาเท่าที่จำเป็นเพื่อบรรลุวัตถุประสงค์ที่กำหนดไว้ในนโยบายความเป็นส่วนตัวฉบับนี้ หรือตามที่กฎหมายที่ใช้บังคับกำหนดหรืออนุญาต ทั้งนี้ ในการกำหนดระยะเวลาเก็บรักษาข้อมูลที่เหมาะสม บริษัทฯ จะพิจารณาถึงลักษณะของข้อมูลส่วนบุคคล วัตถุประสงค์ของการประมวลผล ระยะเวลาของความสัมพันธ์ระหว่างท่านกับบริษัทฯ ข้อกำหนดทางกฎหมายและกฎระเบียบที่ใช้บังคับ และความจำเป็นในการเก็บรักษาข้อมูลเพื่อการก่อตั้ง การใช้ หรือการป้องกันสิทธิเรียกร้องทางกฎหมาย

เมื่อสิ้นสุดระยะเวลาเก็บรักษาที่กำหนด หรือเมื่อข้อมูลส่วนบุคคลของท่านไม่มีความจำเป็นสำหรับวัตถุประสงค์ที่เกี่ยวข้องอีกต่อไป บริษัทฯ จะลบ ทำลาย หรือทำให้ข้อมูลส่วนบุคคลดังกล่าวเป็นข้อมูลที่ไม่สามารถระบุตัวบุคคลได้ โดยใช้วิธีการที่เหมาะสมและเป็นไปตามกฎหมายที่ใช้บังคับ

  1. การเปิดเผยข้อมูลส่วนบุคคล

บริษัทฯ อาจเปิดเผยข้อมูลส่วนบุคคลของท่านแก่ผู้รับข้อมูลดังต่อไปนี้ เพื่อวัตถุประสงค์ที่กำหนดไว้ในนโยบายความเป็นส่วนตัวฉบับนี้ ซึ่งเป็นไปตามกฎเกณฑ์ที่ PDPA กำหนด ทั้งนี้ ในกรณีที่กฎหมายกำหนดให้ขอความยินยอม บริษัทฯ จะขอความยินยอมจากท่านก่อนการเปิดเผยข้อมูลดังกล่าว

  • นิติบุคคลที่เกี่ยวข้องกับบริษัทฯ รวมถึงบริษัทแม่ บริษัทย่อย บริษัทในเครือ และกลุ่มบริษัทอื่น ๆ เพื่อวัตถุประสงค์ด้านการบริหารจัดการภายในและการดำเนินธุรกิจ
  • หน่วยงานของรัฐ หน่วยงานกำกับดูแล หรือหน่วยงานอื่นที่มีอำนาจ ในกรณีที่กฎหมายที่ใช้บังคับกำหนดให้มีการเปิดเผยข้อมูล หรือเป็นไปตามคำขอที่ชอบด้วยกฎหมาย
  • ผู้ให้บริการและที่ปรึกษาวิชาชีพ ซึ่งบริษัทฯ ว่าจ้างเพื่อสนับสนุนการดำเนินธุรกิจของบริษัทฯ ซึ่งรวมถึงผู้ให้บริการด้านเทคโนโลยีสารสนเทศ ผู้ให้บริการแพลตฟอร์มการสัมมนาหรือโปรแกรมการฝึกอบรม ผู้สอบบัญชี นักบัญชี ที่ปรึกษากฎหมาย ที่ปรึกษาด้านภาษี ธนาคาร และผู้ให้บริการอื่น ๆ ซึ่งประมวลผลข้อมูลส่วนบุคคลในนามของบริษัทฯ และอยู่ภายใต้หน้าที่ในการรักษาความลับและการคุ้มครองข้อมูลที่เหมาะสม

ในกรณีที่มีการโอนข้อมูลส่วนบุคคลของท่านไปยังผู้รับข้อมูลซึ่งอยู่ภายนอกประเทศไทย บริษัทฯ จะดำเนินการให้การโอนข้อมูลส่วนบุคคลระหว่างประเทศดังกล่าวเป็นไปตามกฎเกณฑ์ที่ PDPA กำหนด และบริษัทฯ จะจัดให้มีมาตรการคุ้มครองที่เหมาะสม เช่น การทำข้อตกลงการโอนข้อมูลหรือข้อตกลงการประมวลผลข้อมูลเมื่อจำเป็น หรืออาศัยหลักเกณฑ์อื่นที่ชอบด้วยกฎหมายสำหรับการโอนข้อมูลระหว่างประเทศภายใต้กฎเกณฑ์ที่ PDPA กำหนด

  1. สิทธิของท่านในฐานะเจ้าของข้อมูล

ท่านมีสิทธิดังต่อไปนี้เกี่ยวกับข้อมูลส่วนบุคคลที่บริษัทฯ ได้เก็บรวบรวมและประมวลผล:

  • สิทธิในการถอนความยินยอม: ท่านมีสิทธิถอนความยินยอมได้ทุกเมื่อ เว้นแต่ความยินยอมนั้นมีความจำเป็นต่อการปฏิบัติตามหน้าที่ตามกฎหมายหรือข้อผูกพันตามสัญญา โดยดำเนินการตามวิธีการที่บริษัทฯ กำหนดไว้ในขณะที่ท่านให้ความยินยอม ทั้งนี้ การถอนความยินยอมจะไม่กระทบต่อความชอบด้วยกฎหมายของการประมวลผลที่บริษัทฯ ได้ดำเนินการโดยอาศัยความยินยอมของท่านก่อนที่ท่านจะถอนความยินยอม
  • สิทธิในการเข้าถึง: ท่านมีสิทธิเข้าถึงและขอรับสำเนาข้อมูลส่วนบุคคลของท่าน รวมถึงขอให้เปิดเผยถึงวิธีการที่บริษัทฯ ได้รับข้อมูลส่วนบุคคลของท่าน
  • สิทธิในการโอนย้ายข้อมูล: ท่านมีสิทธิได้รับข้อมูลส่วนบุคคลของท่านในรูปแบบที่สามารถอ่านได้หรือใช้กันโดยทั่วไปโดยเครื่องมือหรืออุปกรณ์อัตโนมัติ และมีสิทธิขอให้โอนข้อมูลส่วนบุคคลของท่านไปยังผู้ควบคุมข้อมูลส่วนบุคคลรายอื่น
  • สิทธิในการคัดค้าน: ท่านมีสิทธิคัดค้านการเก็บรวบรวม การใช้ หรือการเปิดเผยข้อมูลส่วนบุคคลของท่านโดยบริษัทฯ
  • สิทธิในการลบ: ท่านมีสิทธิขอให้บริษัทฯ ลบหรือทำลายข้อมูลส่วนบุคคลของท่าน หรือทำให้ข้อมูลส่วนบุคคลของท่านเป็นข้อมูลที่ไม่สามารถระบุตัวท่านได้อีกต่อไป
  • สิทธิในการระงับ: ท่านมีสิทธิระงับการประมวลผลข้อมูลส่วนบุคคลของท่านโดยบริษัทฯ
  • สิทธิในการแก้ไข: ท่านมีสิทธิขอให้บริษัทฯ แก้ไขข้อมูลส่วนบุคคลของท่านที่ไม่ถูกต้อง และปรับปรุงข้อมูลส่วนบุคคลดังกล่าวให้ถูกต้องครบถ้วนและไม่ก่อให้เกิดความเข้าใจผิด
  • สิทธิในการร้องเรียน: ท่านมีสิทธิร้องเรียนต่อสำนักงานคณะกรรมการคุ้มครองข้อมูลส่วนบุคคล หากบริษัทฯ ไม่ปฏิบัติตาม PDPA

หากท่านประสงค์จะใช้สิทธิใด ๆ ตามที่ระบุไว้ข้างต้น โปรดติดต่อบริษัทฯ ตามรายละเอียดการติดต่อที่ระบุไว้ในส่วนท้ายของนโยบายความเป็นส่วนตัวฉบับนี้

  1. มาตรการรักษาความมั่นคงปลอดภัย

บริษัทฯ จัดให้มีมาตรการรักษาความมั่นคงปลอดภัยด้านเทคนิค ด้านกายภาพ และด้านองค์กรที่เหมาะสม เพื่อป้องกันข้อมูลส่วนบุคคลของท่านจากการเข้าถึง การใช้ การเปิดเผย การเปลี่ยนแปลง การสูญหาย หรือการทำลายโดยไม่ได้รับอนุญาตหรือโดยมิชอบด้วยกฎหมาย และเพื่อให้ระดับการรักษาความมั่นคงปลอดภัยเหมาะสมกับความเสี่ยงที่เกี่ยวข้องกับการประมวลผลข้อมูลส่วนบุคคล

ในกรณีที่บริษัทฯ ว่าจ้างบุคคลภายนอกให้ประมวลผลข้อมูลส่วนบุคคลแทน บริษัทฯ จะกำหนดให้บุคคลภายนอกดังกล่าวมีหน้าที่ตามสัญญาที่เหมาะสม และจัดให้มีมาตรการรักษาความมั่นคงปลอดภัยที่เพียงพอและเป็นไปตาม PDPA เพื่อคุ้มครองข้อมูลส่วนบุคคลของท่าน
